Terms of Service
Last updated: 2026. These terms govern your use of Paarl IT services.
1. About Us
Paarl IT ("we", "us", "our") is an IT services company operating in South Africa. By accessing our website, booking a service, or purchasing a product, you agree to be bound by these Terms of Service.
2. Services
We offer the following services:
- On-site and remote IT support (callouts)
- Hardware and software products via our online store
- Managed IT support subscriptions
- Custom software development
- IT consultations
All services are subject to availability and may be modified or discontinued at our discretion with reasonable notice.
3. Accounts and Registration
You may create a customer account to access our portal. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorised use.
You must be 18 years or older, or have the consent of a legal guardian, to register an account and transact on this platform.
4. Payments
Payments are processed securely through the following third-party payment providers:
- iKhokha — used for once-off payments, invoices, and card transactions.
- PayFast — used for recurring subscription billing and online checkout.
By making a payment you agree to the terms of the respective payment processor. We do not store your card details. All transactions are in South African Rand (ZAR).
Invoices are due on receipt unless otherwise stated. Late payments may result in suspension of services.
5. Products and Delivery
Products listed in our store are subject to availability. We operate on a drop-ship model — orders are fulfilled and shipped directly from our supplier network. Delivery is handled by The Courier Guy (Shiplogic). Delivery timeframes are estimates and are not guaranteed.
Risk in goods passes to you upon delivery. Paarl IT is not liable for loss, theft, or damage after delivery has been confirmed.
6. Subscriptions and Cancellations
Subscription plans are billed monthly in advance. You may cancel your subscription at any time through your customer portal. Cancellation takes effect at the end of the current billing period — no refunds are issued for unused days in the current period.
We reserve the right to modify subscription pricing with 30 days' written notice.
7. Software Projects
Custom software projects are governed by a separate project agreement or quote accepted by the client. A deposit is required to commence work. Milestone sign-off constitutes acceptance of that deliverable. Deposits are non-refundable once development has commenced.
8. Acceptable Use
You agree not to use our services to:
- Violate any applicable South African law or regulation
- Transmit malware, spam, or harmful content
- Infringe the intellectual property rights of others
- Attempt to gain unauthorised access to any system or data
9. Intellectual Property
All content on this website, including text, graphics, logos, and software, is the property of Paarl IT or its licensors. You may not reproduce, distribute, or create derivative works without our written consent.
For custom software projects, intellectual property ownership is defined in the project agreement. Unless otherwise agreed in writing, ownership transfers to the client upon final payment.
10. Limitation of Liability
To the maximum extent permitted by South African law, Paarl IT shall not be liable for any indirect, incidental, or consequential loss arising from the use of our services, including loss of data or business interruption.
Our total liability in respect of any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
Nothing in these terms limits liability for fraud, gross negligence, or as otherwise required by the Consumer Protection Act 68 of 2008.
11. Consumer Protection
Your rights as a consumer are protected under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002. These terms do not limit any statutory rights you have under South African law.
12. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
13. Changes to These Terms
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms. We will notify registered users of material changes via email.
